Agreement to Terms

By accessing or using the services of Wildwood Hesperia Decks, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services or website. These terms apply to all visitors, users, and customers who access or use our deck building services.

Services Overview

Wildwood Hesperia Decks provides professional deck building services including custom deck design and installation, composite and wood deck construction, deck repair and restoration, deck replacement, railing and stair installation, deck staining and sealing, and pergola construction. All services are provided in accordance with local building codes and industry standards.

We reserve the right to refuse service to anyone for any reason at any time. We may modify or discontinue services without notice. Prices for our services are subject to change without notice.

Project Estimates and Contracts

All project estimates provided by Wildwood Hesperia Decks are valid for 30 days from the date of issue. Estimates are based on the information provided by you and our site assessment. Final pricing may vary if project scope changes or unforeseen conditions are discovered during construction.

Once you accept an estimate, we will provide a written contract outlining the scope of work, timeline, payment terms, and other project details. Both parties must sign the contract before work begins. Any changes to the scope of work must be documented in writing and may result in additional charges.

Payment Terms

Payment terms will be outlined in your project contract. Typically, we require a deposit before work begins, with progress payments due at specified milestones and final payment due upon project completion. We accept payment by check, credit card, or bank transfer.

If payment is not received according to the agreed schedule, we reserve the right to suspend work until payment is made. Late payments may be subject to additional fees. You are responsible for any costs associated with collection of unpaid balances, including attorney fees and court costs.

Project Timeline

We provide estimated project timelines in good faith based on our experience and current workload. However, timelines may be affected by weather conditions, material availability, permit delays, or other factors beyond our control. We will communicate any delays promptly and work to complete your project as quickly as possible.

Permits and Inspections

We will obtain all necessary building permits for your project as outlined in the contract. The cost of permits is typically included in your project estimate or billed separately as agreed. You are responsible for ensuring we have access to your property for inspections required by local authorities.

If your property has homeowner association requirements or deed restrictions, you are responsible for obtaining any necessary approvals before we begin work. Delays caused by HOA approval processes are not our responsibility.

Warranties

We stand behind our work with a warranty on workmanship as specified in your project contract. This warranty covers defects in our installation and construction but does not cover normal wear and tear, damage from misuse, lack of maintenance, or damage from natural disasters.

Materials used in your project may carry manufacturer warranties. We will provide information about these warranties, but warranty claims must be handled directly with the manufacturer. We are not responsible for product defects covered under manufacturer warranties.

Liability and Insurance

Wildwood Hesperia Decks maintains general liability insurance and workers compensation insurance for all our employees. We are not liable for damage to underground utilities, irrigation systems, landscaping, or other property features that are not clearly marked or disclosed to us before work begins.

Our liability is limited to the amount you paid for our services. We are not responsible for consequential damages, indirect damages, or damages beyond the direct cost of repair or replacement.

Property Access and Safety

You agree to provide safe and reasonable access to the work area for the duration of the project. This includes ensuring pets are secured, children are supervised, and obstacles are cleared from the work area. We will take reasonable precautions to protect your property during construction, but some dust, noise, and disruption is unavoidable.

For your safety, please stay clear of active work areas. Construction sites contain hazards, and we cannot be responsible for injuries that occur if you or your guests enter restricted areas.

Cancellation Policy

If you need to cancel a project after signing a contract, you must notify us in writing. Cancellation terms and any applicable fees will be outlined in your project contract. Generally, deposits are non-refundable if materials have been ordered or work has begun.

Dispute Resolution

If any dispute arises regarding our services, we encourage you to contact us directly to resolve the issue. Most concerns can be addressed through open communication. If we cannot reach a resolution, you agree to participate in mediation before pursuing legal action.

These terms are governed by the laws of the State of California. Any legal proceedings must be filed in the courts of San Bernardino County, California.

Changes to Terms

We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated revision date. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.
